These terms are published in draft so you can see what we intend to hold ourselves to. They have not yet been reviewed by counsel and are not yet a binding agreement. We will say clearly when that changes.

Terms of Service

Who you are contracting with

The service is provided by dotPerson PBC (a working name; the entity is in formation). Mind Hack, Inc., a Delaware corporation, acts as our agent and as reseller-of-record for payments: it is the merchant of record for your subscription and the counterparty for the payment transaction.

The service, as it stands today

Billing is not currently switched on and no feature is gated. You can use aiperson today without paying us anything. This section describes how subscriptions will work once we start charging, so there are no surprises.

Subscriptions and cancellation

  • Subscriptions renew automatically for the term you chose — monthly or annual — until you cancel.
  • Cancellation takes effect at the end of the current period. You keep access until then. We do not cut you off mid-term.
  • No proration. We do not refund the unused part of a period on cancellation, and we do not prorate mid-period upgrades or downgrades.
  • 14-day goodwill refund. If a first subscription is not what you hoped for, ask within 14 days of that first payment and we will refund it. This is a goodwill policy we choose to offer, and it applies to your first subscription rather than to every renewal. It does not displace any refund right you have by law.

Founding Members

The Founding Members programme is an annual plan, capped at 100 members, priced below Pro. It is announced to the waitlist first. When the 100 places are taken it closes — there is no countdown and we will not manufacture urgency around it.

Your data and your content

Your persona and your corpus are yours. We claim no ownership over them. You grant us only the permission we need to run the service you asked for: to store, transmit and process what you send us so it can reach your other devices and inform persona synthesis. You can export everything at any time with personkit export. How we handle it is set out in the privacy policy.

Acceptable use

Do not use aiperson to break the law, to capture other people's conversations without their knowledge where you are required to have it, or to attack the service or the people who use it. We may suspend an account that does, and we will tell you why.

Software licence

The CLI, corpus and MCP server are source-available under the Business Source Licence 1.1, with a Change Date of 19 May 2030 after which they convert to Apache 2.0. The additional use grant permits personal, internal, research and educational use; the carve-out covers offering a memory-layer service to third parties, which needs a commercial licence. The relay's source is not public.

Availability and liability

The service is provided as-is. It is early software and we will not pretend otherwise: it may be interrupted, and features described as planned may change or not arrive. To the extent the law allows, our liability is limited to the amount you paid us in the twelve months before the claim. Nothing here limits liability that cannot lawfully be limited.

Changes to these terms

We will post material changes here and, if you have an account, email you before they take effect. Continuing to use the service after that means you accept them.

Governing law

The payment terms — subscriptions, billing, refunds — are governed by the laws of the State of Delaware, reflecting Mind Hack, Inc.'s role as reseller-of-record. Your local consumer-protection rights are not displaced by this.
